Driver's License and State I.D.

An Alabama driver's license or state issued I.D. may be renewed at the Choctaw County Probate Office Monday through Friday from 8:00 a.m. until 4:00 p.m. The fee is $23.50. If you lose your driver's license or state issued I.D., a duplicate can be issued with the proper identification for a fee of $18.50. At least one of the below listed items are required to be issued a duplicate driver's license or state issued I.D.:

    1.    Social Secuity Card
    2.    Certified birth certificate (required for all 14-15 year old and first applicants)
    3.    Active, retired, reserve, or dependent military ID card
    4.    Other state driver license or previously held Alabama driver license that has not         expired
    5.     Passport (must have I-94 for foreigh students)
    6.     Certificate of U.S. Citizentship (form N-560)
    7.     Certificate of Naturalization (form N-570)
    8.     Alien registration receipt card (Resident Alien, form I-551)
    9.     Certificate of birth issued by the Department of State (form FS-545)
    10.   U. S. citizens born abroad (form DS-1350)
    11.    Marriage license (must have full name and date of birth)
    12.    Certified school record on local school letterhead, signed by custodial of records         (must have applicant's full name and date of birth.)
    13.    Divorce papers (must have full name and date of birth, other ID will be required) 14.    Adoption papers (must have full name and date of birth, other ID will be required)
    15.    Original DD-214 military discharge papers (must have ID)
    16.    Court ordered name change (with full name, date of birth, other ID required)
    17.    Student identification card (must have photograph)

For out-of-state new residents and first-time issuance of an Alabama driver's license or state issued I.D., you must apply with the Alabama Department of Public Safety Office. This is located in the courthouse but is only open on Wednesdays from 8:00 a.m. until 2:00 p.m. the contact number is (205)459-7325.

Marriage License

Marriage Licenses are issued Monday through Friday between the hours of 8:00 a.m. and 3:45 p.m. If you plan to come in the afternoon, you should arrive no later than 3:30 p.m., as the licensing process takes about 15 minutes. The cost of the licenses is $40.00. Cash is the only acceptable form of payment.

The legal age to marry without parental consent in Alabama is 18 years. Persons aged 16 years and 17 years may obtain a marriage license if both parents are present with valid identification and they consent in writing. You must also bring a state certified copy of your birth certificate. A hospital certificate of your birth is not acceptable.

If you are 18 years of age or older, you must bring one of the following: valid driver's license, military identification, or certified copy of your birth certificate. Regardless of age, you will be required to provide proof of you Social Security number. Both parties must be present to be issued a license. Pre-marital blood tests are no longer required by the State of Alabama.

If you have been divorced, you must bring a copy of you Final Divorce Decree. You may not apply for a license within 60 days after you divorce was granted (the date of the written decree), unless you are marrying your former spouse. If your previous spouse is deceased, you must bring a death certificate.

A marriage license is valid for 30 days from the date it is issued and there is no required waiting period for marriage after the license is obtained. This license is only good for marriages performed in the State of Alabama.

This Court has a marriage official who will perform marriages for an additional $15.00 fee. However, this official is an administrative officer of the Court and has many other duties and responsibilities. Marriages must be worked around our Court schedule; therefore, they are only performed on certain days. Anyone interested in being married in this office should call the beginning of the month in which they wished to married to out available dates.

Business License

State/County business licenses are found in over 100 different Sections of the Code of Alabama, 1975. These licenses are required in addition to any business licenses of any municipality in this county and a business may have one or more section codes to be in compliance. Each section is unique and may have different criteria for calculating the license amount due. State/County business licenses are valid for one fiscal year, October 1st through September 30th. Business Licenses must be renewed in the month of October to avoid penalties and interest charges.

Most licenses must be obtained in the county where a business is to be located and are to be purchased prior to the start of business. If you have questions about purchasing or renewing your State of Alabama/County of Choctaw business licenses, please contact our office at 205.459.2414.

Some licenses like auto dealers, food and beverage establishments, air conditioning contractors and others require certain affidavits or state regulatory permits prior to issuance so contact our office with your questions.

Information necessary to purchase licenses: 
Name of Company, Owner Name and Driver License Number, Billing Address, Physical Address, Location Office Phone, Home Office Phone, Federal Employee Identification Number or Social Security Number and a detailed description of the type of business you will be conducting.

Business Privilege License FAQ

Do I need a Privilege License if my business is service only? 
Many service businesses do not need a State of Alabama Privilege License issued by the License Commission; however, there are many that require the license. Contact our office by about your specific circumstance.

I sell only at wholesale. Do I need a license? 
Sellers of tangible personal property at both retail and wholesale are required to have a license, and in some cases more than one license section will apply. Contact our office about your specific circumstance.

I already have a license issued by a city in Choctaw County. Why do I need one from the state/county? 
The state, counties and municipalities regulate businesses within their boundaries. Acquiring a license from a municipality satisfies that entity's requirement but municipalities are within the confines of a county and the state and are subject to the license requirements of those jurisdictions also.

I already have a state/county privilege license from another Alabama County. Do I need to procure a state/county license from Choctaw County? 
Several licenses issued by us are valid statewide; however, most of them are specific to the county where issued. Contact our office and we can verify if additional licensing is required in Choctaw County.

I want to do business with someone that advertises they are "licensed, bonded and insured". How can I check to be sure? 
Contact our office and we can verify if the business in question has (or needs) a State of Alabama Privilege License. Any license required by a State regulatory agency must be certified with that agency. Companies should be able to furnish you with proof of insurance and bonding in much the same way you have to show liability insurance when operating a vehicle.

When does my Privilege License expire, and when can I renew it? 
All Privilege Licenses expire September 30 each year and can be renewed without penalty October 1 through October 31. Early renewals are not allowed.

Is there a penalty if I renew my license late? 
Late renewal is subject to a 15% penalty of the license cost, plus monthly interest.

Can I renew my State of Alabama Privilege License online? 
At this time, renewals can only be made by mail or in person at the Choctaw County Probate office.

I am interested in becoming a licensed car dealer. What do I need to do? 
Alabama law requires that automobile dealers must submit an Act 539 regulatory license to the License Commission prior to issuance of the 51 Privilege License; Act 539 regulatory licenses are issued by the Alabama Department of Revenue in Montgomery. How do I register my boat?

If it is a new boat, a bill of sale is needed. No title is required in the state of Alabama.

If it is a used boat, a bill of sale and the last boat registration certificate or the AL number are required. No title is required in the state of Alabama.

How do I obtain a Hunting License?

A valid Alabama driver license is required.

How do I obtain a Seafood Licenses?

Commercial seafood licenses are issued by Marine Resource Offices only. Locations are at Dauphin Island 251-861-2882 and Gulf Shores 251-968-7576.

How do I obtain a Fishing License?

An Alabama driver’s license is required.

How do I obtain an Alabama Resident Disabled Fishing License?

You must obtain a form from our office, have it completed by a doctor and then return it, along with the proper identification, to our office so that you may purchase an Alabama Disabled Fishing License.
